Under and by virtue of the powers conferred by Section 207 of The Highway Traffic Act being Chapter 82 of the 1962 Statutes of Newfoundland and pursuant to a delegation of power by the Minister of Highways dated the 28th day of January, A.D., 1963 to the St. John's Municipal Council under Section 209 of the Act, and pursuant to all other powers it enabling, the St. John's Municipal Council convened on this 7th day of March, A.D., 1979, hereby passes and enacts the following By-Law relating to the stopping of commercial vehicles on Water Street in the City of St. John's.
BY-LAW
1. This By-Law may be cited as The Water Street Traffic By-Law of the City of St. John's.
2. Notwithstanding any regulation to the contrary and subject to Section 3, a driver, except when a traffic officer, traffic control device or traffic control signal directs otherwise, shall not stop a commercial motor vehicle with more than four (4) wheels causing traction, on that portion of Water Street between Prescott Street and Waldegrave Street in the City of St. John's between the hours of 12:30 p.m. and 6:00 p.m. on every day except Sundays and statutory holidays.
3. The provisions of this By-Law do not apply to:
(1) Emergency vehicles as defined in The Highway Traffic Act.
(2) Vehicles of the St. John's Municipal Council.
(3) Vehicles of the Newfoundland Light and Power Company Limited, Newfoundland Telephone Company Limited, Newfoundland and Labrador Hydro and the Board of Trustees of the Power Distribution District of Newfoundland and Labrador.
(4) Buses of the St. John's Transportation Commission.
4. The Water Street Traffic By-Law of the City of St. John's passed on October 25, 1978 is repealed. |
