1. In these Regulations -
"Bus" means a vehicle designed or used for carrying passengers for hire or reward but does not include a motor vehicle designed to carry less than seven persons in addition to the driver.
"Suburban Bus" means a bus used for the transportation of passengers from or to the City of St. John's to or from any point or points outside the City of St. John's, or plying for hire between the City of St. John's and any point or points outside the City of St. John's.
"Cruising" shall mean the driving on, over or along the streets or public places of the City of St. John's in a vehicle in search of or soliciting prospective passengers for transportation for hire or reward.
"Park" means permit a vehicle, whether occupied or not and whether or not the operator remains in control, to remain in a stationary position otherwise than temporarily in obedience to traffic regulations or traffic signs or the directions of a police constable.
"City of St. John's" means the City of St. John's as defined under Section 6 of The City of St. John's Act being Chapter 87 of the 1952 Revised Statutes of Newfoundland and amendments thereto or as may be defined hereafter by legislative authority.
2. No person shall transport or carry or cause to be transported or carried by bus any person or persons between points within the City of St. John's.
3. No person shall carry or display or cause to be carried or displayed on any vehicle any sign or marker indicating that such vehicle is being operated on or is plying for hire on any route in the City of St. John's or is engaged in cruising.
4. No person shall engage in cruising in the City of St. John's.
5. Except as expressly permitted by these Regulations -
(a) No person shall park a bus on any street or public place in the City of St. John's.
(b) No person shall in the City of St. John's take any person into or upon any bus, or permit any person to enter any bus, or let down or discharge any person from any bus.
6.(1) It shall be lawful to stop any suburban bus at and within the limits of any Suburban Bus Stop designated and marked as such by the St. John's Municipal Council and indicated in Schedule "A" to these Regulations for the immediate purpose of and only for the necessary period of time required for letting down or discharging any passenger or passengers from such bus or taking upon or into such bus any passenger or passengers immediately available as such.
(2) The designation of any Suburban Bus Stop may be cancelled or revoked at any time by the Council and upon such cancellation or revocation such Bus Stop shall not be or be deemed to be a Suburban Bus Stop for the purpose of this Section.
7. It shall be lawful to park a suburban bus, or let down or discharge or take any person upon or into any suburban bus, at a bus stand or terminal situated on land within the City of St. John's, other than a street or public place, which is approved by the St. John's Municipal Council for use as a Suburban Bus stand or terminal.
8. The provisions of these regulations shall not apply to any bus or the owner or operator of any bus operated between points within the City of St. John's under exclusive franchise granted by the St. John's Municipal Council for the transportation of passengers by bus for hire or reward in the City of St. John's.
8A. The provisions of these regulations shall not apply to motor vehicles used solely for the transportation of physically handicapped persons and/or mentally handicapped persons. (Amended 03/10/76 562)
9. The licensing by the Department of Public Finance of a vehicle as a public service vehicle under The Highway Traffic Act, No. 82 of the 1962 Statutes of Newfoundland shall be prima facie evidence that such a vehicle is a bus within the meaning of these Regulations.
10. Any person who violates, contravenes or fails to comply with any of the provisions of these Regulations is guilty of an offence and is liable in the case of a first conviction to a penalty of not less than fifty dollars and not exceeding one hundred dollars, and in the case of a second or subsequent conviction for a similar offence in the same calender year to a penalty of not less than one hundred dollars and not exceeding two hundred dollars, and in default of payment to imprisonment for a term not exceeding three months.
11. The Regulations enacted by the Council on the 25th day of September, 1952, and the 23rd day of October, 1952, respectively are repealed.
