AMENDMENT NO.
SMOKE-FREE PLAYGROUNDS AND OUTDOOR RECREATIONAL FACILITIES BY-LAW
PASSED BY COUNCIL ON May 25, 2009


Pursuant to powers vested in it under section 12 of the Smoke-free Environment Act, 2005, SNL c. S-16.2, as amended, the City of St. John’s Act, RSNL 1990 c.C-17, as amended and all other powers enabling it, the City of St. John’s enacts the following By-Law related to the regulation of smoking in playgrounds and outdoor recreational facilities.
ST. JOHN’S SMOKE-FREE PLAYGROUNDS AND OUTDOOR
RECREATIONAL FACILITIES BY-LAW

1. This By-Law may be cited as the “St. John’s Smoke-Free Playgrounds and Outdoor Recreational Facilities By-Law.”

2. A person shall not smoke at a playground or outdoor recreational facility owned, operated or occupied by the City of St. John’s.

3. In addition to any penalty provided for herein, any person who contravenes the provisions of this By-Law may be ejected forthwith from a playground or outdoor recreational facility.

4. Any person who contravenes the provisions of this By-Law shall be guilty of an offence and liable upon summary conviction to a fine as provided for in section 403 of the City of St. John’s Act, as amended.
