Pursuant to the powers vested in it under the City of St. John’s Act, R.S.N. 1990, c.C-17, as amended and all other powers enabling it, the City of St. John’s enacts the following By-Law relating to the removal of private service laterals.
BY-LAW
1. This By-Law may be cited as the “St. John’s Removal of Private Service Lateral By-Law”.
2. In this By-Law:
(a) “inspector” means any person designated by the City of St. John’s to administer and enforce this By-Law.
(b) “private service lateral” includes any service lateral, line, pipe, or conduit, which is, or was, connected to publically owned water, sanitary and/or storm service mains, lines, pipes or conduits located under or within municipal streets, sidewalks, street reservations, and/or other municipal property, and includes all parts of the private service lateral, line, pipe or conduit (whether located within or under private or public property), from the publically owned water, sanitary, and/or storm service main, line, pipe or conduit to any buildings or otherwise on the private property that is or was serviced by the private service lateral, including, without limiting the generality of the foregoing, all fittings, connections, attachments, valves, access structures (including valve and curb stop boxes, sewer clean-outs, manholes, frames and covers) and otherwise pertaining to the private service lateral.
3. (1) Where the inspector determines that a private service lateral that services or serviced private property is unused, abandoned, inadequate, in need of maintenance, and/or unnecessary to service the property, the inspector may require the owner of the private property, at his/her own expense, to remove, replace, upgrade, maintain, repair and/or otherwise deal with the private service lateral in a manner acceptable to the inspector.
(2) Prior to removing, replacing, repairing, or otherwise dealing with a private service lateral the owner of the property that the private service lateral services or serviced shall, where required by the inspector, obtain a Street Excavation Permit.
4. Any person who contravenes the provisions of this By-Law shall be guilty of an offence and liable upon summary conviction to a penalty as provided for in Section 403 of the City of St. John’s Act. |
