Under and by virtue of the powers conferred by Sections 188 and 189 of the Highway Traffic Act, R.S.N., 1990, chapter H-3, and pursuant to a delegation of power by the Minister of Works, Services and Transportation dated the 27th day of April, 1990, the City of St. John's in regular session convened on this 12th day of November, 2002, hereby passes and enacts the following By-Law relating to the control of access to highways in the City of St. John's.
BY-LAW
1. (a) This By-Law may be cited as the "St. John's Access Control By-Law".
(b) For the purpose of this By-Law "highway" shall have the same meaning as in the Highway Traffic Act.
2. Where Council deems it necessary for the safe regulation of traffic, it may by resolution close, relocate or change the size of any existing access from private property to any street, road or highway in the City, provided that no access from private property shall be closed if by so doing, the private property would be isolated from all streets, roads or highways.
3. Where Council makes a resolution in accordance with section 2, a notice specifying the nature of the closure, relocation or change shall be published in a daily or weekly newspaper in circulation in the City of St. John's and in the Newfoundland Gazette. |
