SKATEBOARD, IN-LINE SKATES AND SCOOTER BY-LAW
PASSED BY COUNCIL ON September 04, 2001


Pursuant to the powers vested in it under the City of St. John's Act, R.S.N. 1990, c. C-17, as amended and all other powers enabling it, the City of St. John's enacts the following By-Law relating to the regulation of skateboards, in-line skates and scooters.
ST. JOHN'S SKATEBOARD, IN-LINE SKATES AND SCOOTER BY-LAW

1. This By-Law may be cited as the "St. John's Skateboard, In-Line Skates and Scooter By-Law".

2. This By-Law shall apply only within the boundaries of the City of St. John's.

3. It shall be an offence for a person to ride on or operate a skateboard in the following public spaces or any portion of the sidewalk or roadway forming part of the following streets:

Water Street (including the War Memorial & Harbour Side Park)
Duckworth Street
New Gower Street
George Street (including Prince Edward Plaza)
Springdale Street (Water to New Gower)
Hutchings Lane
Buchanan Street
Princess Street
Waldegrave Street
Steers Cove
Queen Street
Holdsworth Street
Adelaide Street
Bishop's Cove
McBride's Hill
Ayre's Cove
Baird's (Clift's) Cove
Prescott Street (Duckworth to Water)
St. John's Lane
Holloway Street (Duckworth to Water)
Cochrane Street (Duckworth to Water)
Hill O'Chips
Quidi Vidi/Rennies River Trail
Victoria Park
Bannerman Park
Bowring Park

4.(1) It shall be an offence for a person to in-line skate in the following public spaces:

War Memorial
Harbour Side Park
Prince Edward Plaza
Quidi Vidi/Rennies River Trail
Trails forming part of the Grand Concourse
Virginia River Trail

(2) It shall be an offence for a person to ride on or operate a scooter in the following public spaces:

Trails forming part of the Grand Concourse
Virginia River Trail (Amd. 01/28/02; #1450)

5.(a) No person shall ride on or operate a skateboard or a scooter, or wear in-line skates unless that person is wearing protective coverings for their hands, knees, elbows and a helmet that is designed for skateboard, scooter or in-line skate use and is approved by the Canadian Standards Association, the Snell Memorial Foundation or the American National Standards Association, except as provided for in subsections 5(b) and 5(c).

(b) Members of religious communities who, in accordance with their beliefs, are required to wear religious headgear are not required to wear a helmet while skateboarding, in-line skating or operating a scooter.

(c) Persons who for medical reasons cannot wear a helmet and have provided confirmation of same from a licensed physician are not required to wear a helmet while skateboarding, in-line skating or operating a scooter.

6. No more than one person shall ride on or operate a skateboard or a scooter at a time.

7. Any person who contravenes the provisions of this By-Law shall be guilty of an offence and liable upon summary conviction to:

(i) a fine of twenty-five ($25.00) where the person is issued a ticket; or

(ii) a fine as provided for in section 403 of the City of St. John's Act, as amended, where an Information is laid.

8. The St. John's Skateboard and In-Line Skates By-Law enacted by Council on August 5, 1996, together with all amendments thereto are hereby repealed.
