RESIDENTIAL PARKING AREA BY-LAW
PASSED BY COUNCIL ON May 14, 2001


Pursuant to the powers vested in it under the City of St. John’s Act, RSNL. 1990, c.C-17, as amended and all other powers enabling it, the City of St. John’s enacts the following By-Law relating to the regulation of residential parking.

BY-LAW


1. This By-Law may be cited as the St. John’s Residential Parking Area By-Law.

2. In this By-Law:

“City” means the City of St. John’s;

“Designated Area” means an area of the City of St. John’s designated by the City pursuant to this By-Law.

“Permit” means a parking permit issued pursuant to this By-Law and includes Standard Permits, Visitor Permits and Temporary Contractor Permits.

“Bona Fide Resident” means a permanent resident of a Designated Area who is a registered owner of a motor vehicle.

3. The City may by resolution of Council from time to time

(a) designate areas of the City of St. John’s for the purpose of regulating the parking of motor vehicles; and

(b) designate within an area one or more on-street parking spaces for which parking of motor vehicles is prohibited 24 hours per day except under permit.

4. The areas and parking spaces designated by the City under Section 3 hereof shall be identified by appropriate signs which shall indicate that there is no parking anytime except under permit.

5. (a) The City may issue to Bona Fide Residents of a Designated Area a Standard Permit to park a motor vehicle in that Designated Area.

(b) The City may issue to any business without off-street parking situated in a Designated Area one Standard Permit to park a motor vehicle in that Designated Area.

(c) The City may issue one Visitor Permit to each residential property in a Designated Area. Such Visitor Permit shall only be issued to a residential property owner who is a Bona Fide Resident and shall only be used to park a motor vehicle on the same street as the property of the Bona Fide Resident to which it is issued is situate.

(d) The City may issue to any property registered as an approved Bed and Breakfast in a Designated Area a maximum of four (4) Standard Permits to park motor vehicles in that Designated Area.

(e) The City may issue to a contractor a maximum of two (2) Temporary Contractor Permits to park motor vehicles for a period not to exceed thirty (30) days in a Designated Area. Temporary Contractor Permits may be renewed.

(f) The City may grant permission to professional health care providers to park a motor vehicle in a Designated Area upon a written request being submitted to the Parking Services Division. A professional health care provider granted permission to park a motor vehicle in a Designated Area shall prominently display an approved placard or other form of identification on the passenger side of the front windshield of the motor vehicle.

6. All persons desiring a Permit shall apply to the City by completing the application form prescribed from time to time. Permits will not be renewed unless a new application form has been completed.

7. Proof of residency shall be a valid driver’s license, the motor vehicle’s registration and any other proof which the City may deem necessary.

8. The City may limit the number of Permits issued for any Designated Area. Subject to any such limitation, a Bona Fide Resident of a Designated Area may obtain one Permit for each motor vehicle owned by the Bona Fide Resident for which off-street parking space on his/her property is not available.

9. A Permit issued pursuant to this By-Law shall identify the motor vehicle for which it is issued by having the license plate number of the motor vehicle printed on the Permit.

10. A Visitor Permit issued pursuant to this By-Law shall identify the property address of the Bona Fide Resident to which it is issued by having such address printed on the Permit.

11. Unless otherwise provided, a Permit shall entitle its holder to park the motor vehicle within any of the parking spaces identified by the signs referred to in Section 4 in the Designated Area for which the Permit was issued.

12. A Permit does not exempt the holder from compliance with the provisions of the Highway Traffic Act or any regulations or by-law of the City of St. John’s, including the Snow Clearing Regulations and the Street Cleaning By-Law.

13. With the exception of Temporary Contractor Permits, Permits will be issued on an annual basis and will expire within Designated Areas as determined by the City.

14. The fee for a Permit and every renewal thereof shall be established by Council (Amended 2020/02/24; #1624)

17. All Permits shall be prominently displayed on the passenger side of the front windshield of the motor vehicle.

18. The provisions of this By-Law do not apply to motor vehicles of the City of St. John’s, the Royal Newfoundland Constabulary or emergency vehicles responding to a call or service vehicles responding to a call for the servicing of plumbing, heating or electrical systems, or telephone repair of a dwelling providing that motor vehicle is properly identified.

19. Permits shall not be re-sold or used for purposes other than for that which they were issued.

20. Contravention of Section 19 will result in the Permit being revoked and the motor vehicle to which it is issued or displayed in being ticketed and/or towed.

21. In the event of any person failing to do anything which under this By-Law he ought to have done, the City may do that act and recover the expenses thereof from the person so in default as a civil debt, and without limiting the generality of the foregoing, where a vehicle is parked or left on a City street in contravention of this By-Law, the City, through its employees, servants or agents, may cause the motor vehicle to be removed from the street and impounded at a suitable location and the owner thereof may reclaim the motor vehicle upon payment of the towing and impounding expenses.

22. (a) Any person who parks a motor vehicle in any parking space designated under this By-Law without a Permit or who otherwise violates or contravenes this By-Law is guilty of an offence and is liable to a minimum fine of $60.00 for each offence. (b) Offences under this By-Law may be prosecuted by means of a traffic ticket under the provisions of Part II of the Provincial Offences Act, P-31, S.N. 1995.

23. The St. John’s Residential Parking Area By-Law enacted by the City of St. John’s on May 23, 1995 together with all amendments thereto are hereby repealed.
