Under and by virtue of the powers conferred by Sections 188 and 189 of the Highway Traffic Act, R.S.N. 1990 c. H-3 and pursuant to a delegation of power by the Minister of Works, Services and Transportation dated April 27, 1990, the City of St. John’s enacts the following by-law relating to the control of truck traffic within the City of St. John’s.
ST. JOHN’S TRUCK TRAFFIC BY-LAW
1. This By-Law may be cited as the “St. John’s Truck Traffic By-Law”.
2. For the purposes of this By-Law:
(a) “Designated Area” means the area described in Appendix “A” to this By-Law;
(b) “Inspector” means any official or employee of the City or other person or persons designated by the City to enforce the provisions of this By-Law;
(c) “Person” includes the driver, operator or owner of a Truck Tractor with Trailer;
(d) “Trailer” shall have the same meaning as in the Highway Traffic Act; and
(e) “Truck Tractor” shall have the same meaning as in the Highway Traffic Act.
3.(1) No person shall cause to operate, permit to operate, or operate a Truck Tractor with a Trailer within a Designated Area unless the Truck Tractor with a Trailer has a specified destination within the Designated Area; and
(2) Proof of a destination within a Designated Area shall be produced upon request of the Inspector.
4. Any person who contravenes the provisions of this By-Law shall be guilty of an offence and liable upon summary conviction to a penalty as provided for in Section 403 of the City of St. John’s Act.
5. The St. John’s Truck Traffic Regulations enacted by the City of St. John’s on July 23, 1986 and all amendments thereto is hereby repealed.
