AMENDMENT NO. 1418, 1423, 1507 & 1515
LODGING HOUSE BY-LAW
PASSED BY COUNCIL ON May 23, 95


In pursuance of the powers vested in it under and by virtue of the City of St. John's Act and all other powers enabling it, the City of St. John's enacts the following By-Law relating to boarding houses, lodging houses, tourist homes, hotels and other like establishments.
BY-LAW

1. This By-Law may be cited as "The St. John's Lodging House By-Law".


DEFINITIONS

2. (a) "Lodging House" shall mean a dwelling wherein accommodation is provided for between five (5) and sixteen (16) persons inclusive, and in which kitchen and/or bathroom facilities are used in common by some or all of the occupants. (Amended 02/15/99; #1418)

LICENSING

3. (a) No person shall operate a Lodging House without a license from the City of St. John's which license shall show the approved occupant load and be posted in a prominent position on the said Lodging House. (Amended 10/29/2007; #1507)

(b) The fee for a Lodging House license shall be one hundred dollars ($100.00) per year and a Lodging House license shall be annual license effective from January 1 to December 31 of the calendar year for which it was issued.

(c) A Lodging House license shall not be granted if the Lodging House owner or the Lodging House has failed to comply with the provisions of this By-Law and the City of St. John's Act.

(d) A Lodging House License may be revoked if the Lodging House owner or the Lodging House is in contravention of this By-Law or the City of St. John's Act and the by-laws and regulations made thereunder.

3.1 Notwithstanding any other provision of this By-Law any person who owes outstanding fines to the City of St. John’s for a by-law or regulatory violation for which he has been convicted shall not be entitled to a license issued pursuant to this By-Law until such time as all such outstanding fines have been paid and proof of payment, in a form acceptable to the Inspector, has been provided to the Inspector. Sections 4, 5 & 6 are repealed (Amended 02/15/99; #1418)

REQUIREMENTS

4. Lodging Houses shall comply with the provisions of the Life Safety Code. (Amended 02/15/99; #1418)

5. Lodging Houses shall have common central cooking and kitchen facilities which are accessible by all occupants. (Amended 02/15/99; #1418)

PROSECUTION

6. Any person who contravenes the provisions of this By-Law shall be guilty of an offence and liable upon summary conviction to a fine as provided for in Section 403 of the City of St. John's Act. (Amended 02/15/99; #1418)

7. In a prosecution for a violation of this By-Law, occupation of a dwelling by persons who are unrelated to the owner shall be prima facie evidence that the dwelling is a Lodging House and the burden of proving otherwise shall be upon the owner of the dwelling. (Amended 02/15/99; #1418)

8. The Lodging House By-Law enacted by the City of St. John's on July 8, 1981, together with all amendments thereto, is hereby repealed. (Amended 02/15/99; #1418)
