Pursuant to the powers vested in it under and by virtue of Section 29 and Section 162 of the City of St. John's Act, R.S.N. 1990 c. C-17 as amended and all other powers it enabling, the St. John's Municipal Council in regular session convened on this 15th day of November, A.D. 1993, hereby passes and enacts the following By-Law relating to the use of airguns in the City of St. John's.
BY-LAW
1. This By-Law may be cited as the City of St. John's Airgun By-Law.
2. For the purpose of this By-Law:
(a) airgun includes those guns commonly referred to as B.B. and Pellet guns and all guns operated by pump or spring mechanisms and compressed gas cylinders regardless of the muzzle velocity;
3. Except as hereinafter provided it shall be unlawful for any person to fire or discharge an airgun in the City of St. John's.
4. No airgun shall be transported or moved from the airgun holder's private property except under the following conditions:
(a) the airgun shall be rendered inoperable;
(b) the airgun shall be, at all times, fully encased and enclosed in a case or holder made and used specifically for transporting the airgun and no part of the airgun shall be exposed to the public; and
(c) all ammunition and compressed gas cylinders that may be used for the operation of the airgun shall, at all times, be entirely separate from the case in which the airgun is fully encased or enclosed.
5. A police officer may seize any airgun where there are reasonable and probable grounds to believe that an offense has been committed pursuant to Section 3 or Section 4.
6. Where a charge is not laid pursuant to Section 3 or Section 4 within a period of 30 days from the date of the offence, any airgun seized pursuant to Section 5 shall be returned.
7. The provisions of this By-Law shall not apply to:
(a) any person where prior approval for the discharge or use of an airgun has been received from the City; and
(b) the firing or discharge of an airgun on a range approved by the City for the said use.
8. Any person who contravenes the provisions of this By-Law shall be guilty of an offence and liable upon summary conviction to a penalty as provided for in Section 403 of the City of St. John's Act. (Amended 07/24/95; #1358) |
