Pursuant to the powers vested in it under Section 170 of The City of St. John's Act and all other powers it enabling, the St. John's Municipal Council in regular session convened on this 22nd day of March, 1989, hereby passes and enacts the following Snow Removal Regulations governing the removal of snow and ice from sidewalks, gutters, houses, yards and parking lots in the City of St. John's.
BY-LAW
1. This By-Law may be cited as The St. John's Snow Removal Regulations.
2. This By-Law shall apply only within the limits of the City of St. John's.
DEFINITIONS
3. In this By-Law,
(1) "Abutter" includes
(a) any person who, alone or jointly or severally with others shall have the legal title to land abutting a street or sidewalk, with or without actual possession thereof, but shall not include a mortgagee not in possession,
(b) in the case of property held under a building lease, the lessee or his assignee, including in the term "assignee" a sub-tenant for the whole or substantially the whole of the remainder of the term thereof, and
(c) the occupant, where such occupant is made responsible for the repair and maintenance of the property by the lease or agreement, whether in writing or not, under which he occupied the property,
(2) "City" means the City of St. John's as incorporated by the City of St. John's Act, R.S.N. 1970, Chapter 40, and amendments thereto and includes the Council as defined by the Act;
(3) "Commercial Property" shall mean any property or building that is used or designed for use in whole or in part for business, commercial or industrial purposes, but shall not include any property or building used for institutional purposes;
(4) "Institutional purposes" means non-commercial purposes carried on by a non-profit society for promoting a social, educational, cultural, religious or philanthropic objective and, without restricting the scope of this definition, may include homes for the aged, or mentally, physically or socially handicapped persons, convalescent homes, nursing homes, sanatoria, or hospitals, churches, schools and universities.

shall remove all snow and ice;
(a) from all sidewalk which abuts any side of their commercial property,
(b) from any path leading from a sidewalk abutting their commercial property to the roadway,
(c) between any sidewalk abutting their commercial property and a crosswalk.
5. Snow and ice removal shall be accomplished within the following time limits: Snow and ice accumulated between 4:00 o'clock p.m. of one day and 4:00 o'clock p.m. of the next day shall be removed by 12:00 o'clock midnight on that next day.
6. No person shall permit icicles to accumulate on the eaves or gutters of any building on a commercial property owned or occupied by him so as to become dangerous to persons passing on a sidewalk, street or pathway.
7. (1) No person shall deposit snow or ice upon any street or sidewalk which street or sidewalk is cleared of snow or ice by the City.
(2) Any cost to the City of removing snow or ice deposited in violation of subsection (1) shall, in addition to any penalty prescribed hereunder, be recoverable from the violator or abutter. (Amended 2011/03/28; #1543)
8. (1) No person engaged in removing snow or ice from any property or other premises shall do so in any manner that obstructs vehicular traffic on a street or pedestrian traffic on a sidewalk.
(2) Any cost to the City of removing snow or ice deposited in violation of subsection (1) shall, in addition to any penalty prescribed hereunder, be recoverable from the violator or abutter. (Amended 2011/03/28; #1543)
9. Where an abutter fails to remove snow or ice as required by these Regulations, the City may give, or cause to be given, to the abutter an order to remove the snow and ice within twenty-four hours. Upon the failure of the abutter to comply with such order the necessary removal of such snow and ice, the City may remove or cause to be removed such snow and ice and may recover the cost of such work from the abutter.
10. Any person who contravenes the provisions of these Regulations shall be guilty of an offence and liable upon summary conviction to a penalty as provided for in Section 403 of the City of St. John’s Act, or where a violation notice is issued, to a penalty as provided for in Section 403.2 of the City of St. John’s Act. 11. The Regulation relating to Snow Clearing passed and enacted by Council on January 25, 1934 and all amendments thereto are hereby repealed.
