BY-LAW NO. 1464
AMENDMENT NO. 1508, 1515, & 1656
POOL BY-LAW
PASSED BY COUNCIL ON January 05, 2004


Pursuant to the powers vested in it under the City of St. John’s Act, R.S.N. 1990, c.C-17, as amended and all other powers enabling it, the City of St. John’s enacts the following By-Law relating to pools in the City of St. John’s.
BY-LAW

1. This By-Law may be cited as the “St. John’s Pool By-Law”.

2. In this By-Law

(a) “Pool” means a swimming pool, whether in-ground or above ground, a landscape water feature, fountain or decorative fish pond, outdoor hot tub, outdoor
whirlpool or swimspa. (Amended 2023/03/27; #1656)

(b) Rear Yard” means the space on a property between the rear boundary line and the rear wall of the main structure situate at the property.

3. This By-Law shall apply to all exterior pools having a depth of 600 millimeters (600 mm) or greater.

4. Pools shall be located

(a) in the rear yard of a property, unless otherwise approved by the Director of Building and Property Management; and

(b) on a property such that they meet the minimum zone requirements for an accessory building as set out in the St. John’s Development Regulations for the zone
in which the property is situate.

(c) in compliance with the Canadian Electrical Code with respect to overhead power and communication cables.” (Amended 2023/03/27; #1656)

5. Pools shall be fully enclosed by a fence which fence shall be

(a) not less than 1.8 metres in height;

(b) designed in a manner which does not facilitate climbing; and

(c) fitted with a gate which meets the requirements set out in section 6.

6. (1) All gates shall be:

(a) equipped with locks;

(b) of the same height as the fence;

(c) designed in a manner which does not facilitate climbing; and

(d) equipped with self-closing and self-latching devices.

(2) The self-latching device on a gate shall be located not less than 1.5 metres from the bottom of the gate and on the inside of the gate.

7. Gates shall be closed and locked when the pool is not in use.

8. A permit shall be obtained prior to the construction, placement, alteration, repair or relocation of any pool or fence enclosing a pool.

8.1 Notwithstanding any other provision of this By-Law any person who owes outstanding fines to the City of St. John’s for a by-law or regulatory violation for
which he has been convicted shall not be entitled to a permit issued pursuant to this By-Law until such time as all such outstanding fines have been paid
and proof of payment, in a form acceptable to the inspector, has been provided to the inspector. (Amended 2008/04/07; #1515)

9. Any person who contravenes the provisions of this By-Law shall be guilty of an offence and liable upon summary conviction to a penalty as provided for in
Section 403 of the City of St. John’s Act, or where a violation notice is issued, to a penalty as provided for in Section 403.2 of the City of St. John’s Act
